Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to:
a)  The hazards of falls on the north east corner of the building an
employee was working from an
elevated wooden pallet.  The pallet was being elevated by a forklift.  The
employee was working at a height of
approximately 15 feet (4.572m).  The pallet was not secured to the forks
of the lifting device and the pallet
did not offer any fall protection.  Among other methods, one feasible and
acceptable abatement method to
correct this hazard is to provide the employee with a personnel work
platform, with standard guardrails,
designed to be lifted by a forklift and secure this platform to the forks/
carriage of the forklift.
