Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)  On or about 06-21-00 at 5514 I-35, New Braunfels, TX two employees
were observed
working in an elevated bucket of a front-end loader.  The hazard
associated from falls while
working at a height of approximately 10 feet exist due to the fact that
the bucket offered little to
no fall protection.
b)  Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to use a lifting device designed to lift personnel that had the
appropriate guard rails.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employees in that employees
were exposed to:
a)  On or about 06-21-00 at 5514 I-35, New Braunfels, TX an employee was
observed
operating a front-end loader without wearing his safety belt.  The CASE
front-end load Model
580L, S/N 6323 did have a Rollover Protective Structure (ROPS) and thus is
required by 29 CFR
1926.602(a)(2)(i) to have a seat belt.  The employer failed to ensure that
the employee was
trained and wore the required safety belt while operating this equipment,
thus exposing the
employee to a crush-by hazard.
b)  Among other methods, one feasible and acceptable abatement method to
correct the
hazard is to trained the employee about the safety features of the
equipment that he is assigned to
operate and ensure that the employee utilizes all safety features.
