Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 07-20-00 at 4343 Industrial Center Dr., San Antonio, TX the employer exposed the employee to a rotating part hazard. The employer modified a drill press with a micro-switch. The purpose of the switch was to start/ turn on the drill motor when the drill presses "vertical movement level" is pulled and to shut off the drill motor when the "vertical movement level" is released. The hazards exist when an employee has the drill chuck in his hands, as to change out drill bits, etc., and pulls down on the drill chuck. If the employee pulls down on the drill chuck, while changing out drill bit apparatuses, the drill motor will inadvertently start without warning, thus exposing the employee who has the drill chuck in his had to injury. Among other methods, one feasible and acceptable abatement method to correct the hazard is to remove the after market micro-switch modification and return the drill press to as manufactured condition, which meet OSHA, ANSI, and other requirements.
