Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 07-14-2000 at the Kingsland Water Supply Corp. Kingsland Tx. construction site a 1990 Putzmeister number 2890090001 concrete pump truck's boom was closer than 17 feet (5 m) minimum distance to overhead power lines required by the truck's manufacturer. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow manufacturer's guidelines as specified in the operator's manuas and safety decals.
