Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 08-11-00 at 3440 E. Houston, San Antonio, TX an employee was observed working from a pallet which was being elevated by a forklift. The employer failed to provide the employee with any type of fall protection while he worked from this elevated position. b) Among other methods, one feasible and acceptable abatement method to correct the hazard is to provide the employee with a work platform, secured to the lifting device, which has standard guardrails and to follow all manufacturer's recomendations and limitations for this type equipment.s
