Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) The hazard of being struck by moving pipe and fittings, in that on or
about 02-05-01,
a labor crew was doing a pressure check on a 5000 gallon separator tank at
a plant under
construction near Franklin, Tx. The foreman noticed water spurting from a
ball valve and
walked over in front of it. The valve failed and the sudden release of
energy caused by pressure
and the valve struck the victim in the groin, fatally injuring him. Among
other feasible and
acceptable methods to correct this hazard or method would be to secure all
pipe and fittings with
safety chains or cables, and put a gauge on the water line being used to
pump water into the
tank.

a labor crew was doing a pressure test on a 5000 gallon separator tank at

construction. A 1500 psi rated valve was being used and a pressure test of
over 2100 pounds
was being done on the tank. The valve failed and part of the valve and
water under pressure
struck the foreman of the crew, killing him. Among other feasible and
acceptable methods to
correct this hazard or method would be to obtain a valve with a pressure
rating at least equal
to the test pressure on the tank.
