Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) At the Delphi Automotive Saginaw Plant, Athens, AL., on are about 01/08/02 Employees were not using the restraint device that were provided on the Hyster 10,000 lb forklift # 80. Employees were exposed to crushing injuries in the event the forklift tip-over. Among other methods, one feasible and acceptable method would be to ensure that all fork lift drivers use the seat belts that are installed on the fork lifts.led
