Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to head and crushing injuries: (a)At the Wayne's Acoustical & Drywall, Inc. construction site located at 678 Discovery Drive, Huntsville, AL., the employer did not instruct each employee in the recognition and avoidance of unsafe conditions applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury. Two employee's were working 40 plus feet in the air from two separate JLG Aerial lifts, one aerial lift was directly above the other with the movement of the above employee the lower employee was being struck in the head by the floor (base) of the top JLG Aerial lift. Among other methods, one feasible and acceptable method would have been to provide employees with training that would allow the employee(s) to recognize unsafe conditions. REFERENCE ANSI STANDARD A92.5ARD
