Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed: (a)At the Ellard Construction Inc.,/Ellard Contracting Company Inc., construction site located at Pell City Industrial Park, Pell City, AL., an employee was crushed between the ejector bowl and the cross members of Scraper Unit #120 Model 631D Serial Number 26W426 while checking welds that had been performed earlier in the day. Among other methods, one feasible and acceptable method would have been to instruct employees on the hazards of placing their body within the danger zone while scraper is in operation in accordance with operators manual.rs
