Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm in that
employees were exposed
to the hazard of falling into a permanently open floor opening:
a. K-1 and K-2 Process, pipe manufacturing is conducted inside a circular
pit, measured 6 feet
6 inches deep at the K-1 process and 6 feet 8 inches deep at the K-2
process. Employees are
exposed to falling into the pits during operating hours. During pipe
manufacturing the floor
opening is reduced to about 16 to 22 inches with just the core is in place
and about 13 to 16
inches with a core and a casing in place. When manufacturing is not in
progress the open
circular pits may be about eight feet in diameter.
Among other methods one feasible and acceptable method to correct this
hazard and protect
employees is to install guardrail protection or barricades around the
processes or to use fall
protection such as full body harnesses attached to lanyards and lifelines.
