Title 21 V.S.A. Chapter 3, Subchapter 5, Section 223 (a), Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause death or serious physical harm to employees, in that employees were exposed to: falls and/or engulfment; Location: A) Ingredient bins, bulk unloading area. B) Bulk receiving control room, right side wall C) Bulk loadout bins. Violation: The employer did not insure that employees required to enter and perform work while suspended from a tripod and winch system with a body harness, were provided with the means to properly tie off vertical lifelines, when such equipment was provided as a means of fall and engulfment protectionand that damaged body harnesses were properly removed from service.
