Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about June 2, 2000 Herlihy Mid-Continent permitted employees to work from a wheel- loader bucket while handling lagging under a bridge deck. This activity exposed employees to fall hazards of up to eight feet and to the hazard of being crushed between the loader bucket and fixed objects such as bridge girders. Among other feasible and acceptable abatement methods to correct this hazard include the safe use of approved personnel lifting equipment designed to elevate personnel to work stations above ground such as, but not limited to articulating and or extensible boom platforms. No abatement certification or documentation is required for this item.
