Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: The employer failed to develop and implement procedures to prevent the accidental mixing of muriatic acid with calcium hypochlorite tablets in a water chlorinator housing. An acid solution was used to de-scale or remove calcium deposits from the interior walls of the chlorinator housing. On April 3, 2000, at approximately 12:30 p.m.,a pool and spa contractor added calcium hypochlorite tablets to an unlocked/untagged chlorinator filled with an muriatic acid solution. The chemical reaction that resulted blew the cover off the chlorinator housing and released chlorine gas into the pool and surrounding hotel areas.
