Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards of failure of pressurized metal piping which was not properly repair welded. Proper AWS required welding techniques were not followed in that the repair welds were not ground out and filled properly with weld. Employees would be exposed to injury when evaluating the system for leaks which must be performed while the system is pressurized. Feasible abatement methods could include any combination of the following: 1) Administrative controls to prevent employee exposure to affected areas. 2) Establish a procedure to properly repair and document weld quality and integrity through use of magnaflux that presents the results in a quantifiable form and apply the procedure to the above listed areas of concerns, making improvements where necessary to improve detected quality deficiencies, and certify the findings and the final established status as meeting acceptable engineering repair criteria.
