Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or before May 13, 2000, employees who cleaned the sparge line in the
railroad tank cars,
were exposed to potential falls, eye injuries, etc., caused by the
unexpected activation of the
water.  On May 13, 2000, an employee was cleaning out the sparge line in a
railroad tank car.
After the line was cleaned out, the employee was final rinsing the bottom
of the tank car when
he slipped, thus causing the snake to hit the employee in the eye.  The
employee was not in
control over the water pressure coming into the line.  The water pressure
was controlled by foot
pedal by an employee outside the tank car.
Among other methods, one feasible and acceptable method to correct the
hazard(s)
is to have
the blast cleaning nozzle equipped with an operating valve which must be
held open manually
by the employee performing the flushing operation.  Another method would
be to establish a
procedure for flushing operations.
NOTE: In lieu of a manually held operating valve, the employer may use an
open hose.
