Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On July 25, 2000, at a work site on Bradley Road, Westlake, OH, flaggers being utilized to direct one-way traffic for a limited distance of approximately 200 to 300 feet, did not have an adequate means of communication between the two employees. The location of the worksite was narrow, with heavy vehicular traffic and high level of construction activity. The employees were provided with flags only to coordinate and control traffic. At the time of inspection no other means of communication were provided. Communication between the two workers was restricted to a visual of hand and flag movements which had the potential to be either misinterpreted or not observed. Among other methods, feasible and acceptable abatement methods to correct this hazard is to either provide radio communication between the two flaggers, or utilize traffic paddles at both ends of the site insuring a smooth and coordinated flow of traffic as directed in the US Department of Transportation's Manual on Uniform Traffic Control Devices (MUTCD).
