Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls in excess of 25 feet while riding the line of the base-mount dual-drum hoist performing renovations on the guyed tower at 9466 Ridge Road. The mechanical Skagit hoist was not provided an automatic secondary brake. Primary braking was not automatically applied upon return of the control lever to the center(neutral position). Controls were not self-centering "deadman" type that would return the machine to neutral and engage the drum brakes when the control lever was released. The older model, logging industry type, tree dragging hoist was not provided sufficient and automatic braking and controls to be capable of providing safe hoist line riding for employees during tower access and egress at heights up to approximately 700 feet. Among other methods, one feasible method of abating the hazard and permitting employees to safely ride the hoist line to work stations aloft in excess of 200 feet is to replace or upgrade the base-mount drum hoist to bring it into conformance with OSHA Directive CPL 2-1.29, effective January 15, 1999; Interim Inspection Procedures During Communication Tower Construction Activities. An alternative is to utilize the internal ladder mounted to the tower along with a ladder-safety cable, safety climb device attached to a harness.
