Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: a scissors lift was operated at heights in excess of 10
feet without complete
guardrails in place.  The midrail was taped to the top rail.
Among other methods, one feasible and acceptable method to correct the
hazard is to follow the
Self Propelled  ANSI A 92.6 - 1990 or newer.  One feasible method of
abatement would be to
implement and enforce the use of the ANSI A92.6-1990 or newer;
Self-Propelled Elevating
Work Platforms.
1.  Per 7.3.3 - Prestart Inspection: Provide visual inspections each day.
2.  Per 7.9 - During Operation: (3) Guardrails are to be installed and
access openings closed per
the Manufacturer's instructions.
3.  Per 7.6 - Operator Training:  Ensure operators are trained on the
manufacturer's
operating
manuals and this ANSI standard prior to operating the scissors lift.
4.  Per 7.11.4 - Altering Safety Devices: Altering or disabling interlocks
or other safety devices
shall be prohibited.
OR, IN THE ALTERNATIVE;
29 CFR 1926.300(b)(1):  Power operated equipment designed to accommodate
guards, were not
equipped with such guards when in use:
At the Ameritech Steel worksite on Ethan in Streetsboro, the employer did
not ensure that the
employees working from the Scissors lift were provided complete guardrails
where the midrail
was taped to the toprail on the end of the platform.
