Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of crushing injuries, when standing/leaning out between moving tractor trailers and dock walls. a)Dock Bay 10 Area Employee had finished loading furniture and was taking a break in trailer # 54. A truck driver, without walking back and verifying that no employees were in the rear of the trailer, backed under the trailer, to connect the fifth wheel of the tractor to the trailer. As the employee stuck his head out between the trailer and the dock wall, the trailer continued to move backwards towards the dock, resulting in the employee's head to be crushed between the trailer and dock wall, on or about 05/02/00. ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO: 1. Strictly enforce the existing safety policy prohibiting employees from standing/working near edge of platforms, when trailers are moving into or out of platform areas. 2. Implement and enforce a strict policy that trailers are not to be hooked up or moved, until the Dispatcher and Driver, have verified that all employees and equipment have been removed from the trailer. 3. Follow the National Safety Council's Motor Fleet Safety Manual, Chapter 8 Driver Training, which under paragraph entitled " Backing Accident Prevention",the driver is to get out of the vehicle before moving and size up the situation. 4. Follow the National Safety Council's Motor Fleet Safety Manual, Appendix H How to Drive a Truck, which under paragraph entitled " Coupling Tractor to Trailer", number 4., states, "Check to see if there are any hazards around or in back of trailer". ***ABATEMENT VERIFICATION IS REQUIRED***N
