Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A crushing fatal injury while working at or near a D-8 dozer with its 'V' blade in the raised position attempting to hook a pull cable to the dozer's "eye" hook located on the front of the equipment. Employee attempted to crawl under the raised 'V' blade just as the operator released the blade in "free" fall, crushing the employee. This occurred ata asite clearing approximately 5 miles SE of Morobay, Arkansas near Hwy. 5 & 275 junction on 8-6-00 at approximately 10:00 A.M.."Amoung other methods, one feasible and acceptable abatement method to correct would be to provide adequate training to operators following the published safety and maintenance manual provided by the manufacturer, Caterpillar Tractor, ensuring that each employee has read and understands the contents of the manual, including the warning signs posted inside the cab at or near the operators station.s
