Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)On 5/11/2000, Norton & Goodman Street, Eckerd Store, Rochester, NY.  A
platform (pallet attached to the forks of a Gradall was being used to lift
an
employee.  The platform was not provided with standard guard rails on all
open
sides to prevent the employee from falling.  The employee was exposed to a
fall
distance of 10 feet 6 inches to the ground below.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to:  1)  Utilize a safety platform which meets the requirements
of ANSI ASME
B56.6 - 1992 Safety Standard for Rough Terrain Forklift Trucks, Part III,
paragraph
8.25.1;  2)  Instruct and train employees in the proper use of forklifts
including
the use
of safety platforms;  3)  Follow the requirements of ANSI ASME B56.6 -
1992,
paragraph 5.15.1 for elevating personnel.
