T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. In that, an employee was operating a scissor lift approximately 2 feet from an open hole 4 inches deep with no cover. One feasible abatement would be to cover the hole with plywood.
