T.C.A. 50-3-105(1): The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: being thrown from and subsequently struck by equipment during equipment rollover. In that an employee was operating a tractor equipped with rollover protection, on a golf course with various hills and slopes, without the use of a seat belt or other restraint device to keep the operator from being thrown from the vehicle during a rollover. This equipment rolled over and threw the driver to the ground, where the driver received fatal injuries when the tractor rolled onto him. Among others, one feasible method of abatement would be to insure seats belts are provided on equipment having rollover protective structures (ROPS).
