T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were Operating forklifts with out wearing seat belts provided. The National Consensus standard ASME B56.1.1993 requires that use of an operator restraint system when equipped on a powered industrial truck. In that, the employees were not wearing seat belts while operating fork lifts. The employees operate the lift trucks 8 hours daily throughout the plant. Among others one feasible abatement is to have employees wear the seat belts the manufacture put on the lift trucks.ture
