Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of being struck by or caught under a moving rail car while getting on or off. On or about 5-30-00, the Terex endloader serial number C4551 used to move railcar NS 195417 into the yard area was not equipped with a device or method to hold the railcar in place for employees to get on/off. "Among other methods, one feasible and acceptable abatement method to correct hazard is to use the trackmobile to move railcars with at all times, and/or install couplers on the Terex endloader."
