Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a.  Receive serious injuries due to that an operator Caterpillar model
D8K, serial
#77V18534 with rollover protective structure was not using the safety belt
while the
operating the equipment. Among other methods one feasible and acceptable
method to
correct his hazard is to require the use of the safety belt at all times.
a.  Recibir lesiones serias debido a que el operador de un Caterpillar
model D8K, serie
#77V18534 con estructura contra vuelco no estaba usando el cinturon de
seguridad
cuando operaba el equipo.  Entre otros metodos correctivos, uno seguro y
efectivo para
corregir este riesgo es requerir el uso del cinturon de seguridad en todo
momento.

18534 that was not trained in the safe operation of this equipment.  Among

methods, one feasible and acceptable abatement method to correct this
hazard is giving
training to all operators before they start to use the equipment.
