Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a.  Receive injuries due roll over of the equipment.  An unsafe road was
used to
transport a bulldozer trademark Caterpilar model D8K, serial #77 V 18534
over a
platform of 40 feet long, 8.6 feet wide and 10 feet high aproximately.
The neighborhood
road has some irregularities.  The asphalt space was 8-9 feet wide
aproximately has
different curves, and up and down hills, trees around and over the road.
In the border
of the road an slope of 50-60 feet aproximately to the river.  Among other
methods, one
feasible and acceptable method to correct this hazard is to dismount the
equipment from
the carryging platform before the dangerous area on the road is approach
and drive it to
passed that area, then transport it again to its destiny.
a.  Recibir lesiones debido a vuelco del equipo.  Se usaba una carretera
vecinal insegura
para transportar un bulldozer Caterpilar modelo D8K, # de serie 77 V 18534
sobre una
plataforma de 40 pies de largo, 8.6 pies de ancho y 10 pies de altura
aproximadamente.
La carretera tiene varias irregularidades.  El ancho del asfalto es de 8-9
pies
aproximadamente tiene muchas curvas, tiene cuestas, tiene arboles
alrededor y encima
que obstruyen el paso libre.  Tiene abismos de 50-60 pies al borde del
camino
hacia el
rio.   Entre otros metodos correctivos, uno seguro y aceptable para
corregir este riesgo,
es desmontar el equipo (bulldozer) de la plataforma de carga antes de
pasar por una area
peligrosa de la carretera y guiarlo hasta pasar esa area, luego volver a
transportarlo para
llevarlo a su destino.
