Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a. Receive serious injuries due to the absence of a portable emergency
stop control when
working in the proximity of the crusher and pulverizer (manufactured by
Williams Patent
Chrusher and Pulverizer Co. Inc. model #60 TF Shredder, serial #14442)
which was fed
by a conveyor. Among other methods, one feasible and acceptable abatement
method
to
correct this hazard is that at those points where employees are normaly
stationed, the
conveyor shall be equipped with permanently installed pull cords or
similar stop
controllers.
a. Recibir lesiones serias debido a la ausencia de un control portatil
para paradas de
emergencia cuando se trabaja en las proximidades del triturador y
compactador(fabricado
por William Patent Chrusher and Pulverizer Co. Inc. modelo no 60 TF
Shredder,serie
#14442) el cual era alimentado por un "conveyor". Entre otros metodos, un
metodo
aceptable y posible para corregir este riesgo es que en todos aquellos
puntos donde el
empleado normalmente esta estacionado, el conveyor tiene que ser equipado
con cables
permanentes para halar en caso de emergencia o controles de parada de
emergencia
similares.

estaban expuestos
a:
a. Receive serious injuries due to the inherent ballistic action of the
grinding operation
in a Shredder (Manufactured by Williams Patent Chrusher & Pulverizer Co,
Inc.model
number 60 TF Shredder, serial #14442) that can cause that the pieces of
the material
being processed  be thrown out the feed or discharge openings and injure
personnel in
the vicinity. Among other methods, one feasible and acceptable abatement
method to
correct this hazard is to provide and maintain proper screens (the ones in
use are not
effective),and shrouds at all the mill openings to contain the material
being processed
inside the hopper or mill.
a. Recibir lesiones serias debido a que la accion balistica inherente a la
operacion de
moler o triturar en una trituradora ( Fabricada por Williams Patent Chruser
Co.Inc.modelo #60 TF Shredder,serie #14442) que puedan causar que pedazos o
particulas del material que esta siendo procesado, sea disparado fuera del
alimentador o
conveyor u por otras salidas y puedan lesionar al personal en los
alrededores. Entre otros
metodos correctivos, uno aceptable y posible para corregir este riesgo es
proveer y
mantener una pantalla protectora apropiada (la que esta en uso no es
efectiva), y sudarios
(mortajas protectoras) en todas las salidas del molino para contener el
material procesado
en el interior del molino.

while
the
equipment was in operation. Among other methods, one feasible and
acceptable
abatement method to correct this hazard is to provide overload devices or
suitable
warning means, so the employees do not enter the area.
a. Recibir lesiones serias debido a que los trabajadores cruzaban la linea
roja para
empujar sobrecarga atorada hacia el triturador (Conveyor Shredder and
Hugger fabricado
por Williams Patent Chrusher and Pulverizer Co. Inc. modelo #60 TF, serie
#14442)
mientras el equipo estaba en operacion.  Entre otros metodos, un metodo
correctivo
aceptable para corregir este riesgo es proveer un aditamento para indicar
y/o controlar
la sobrecarga en el conveyor, u otro medio de advertencias de tal modo que
el empleado
no entre en el area.

method to correct this hazard is to provide and elevated protected
platform (with
guardrails and safe access) for service and maintenance of the machine

de goma desatorando carga hacia la trituradora (fabricada por William

caidas de alturas de 18 a 20 pies.  Entre otros metodos uno aceptable para
corregir este
riesgo es proveer una plataforma elevada protegida (con barrandas y acceso
seguro) para
servicio y mantenimiento de la maquina.
