ORS 654.010 The employer did not furnish employment and a place of
employment which
was safe for employees therein, and did not furnish such devices and safe
guards and use
such practices, means, methods, operation and processes as were reasonably
necessary to
render such employment and place of employment safe, and did not do
everything reasonable
to protect the life and safety of such employees.
A: As evidenced by:
1. Having a radio communication system that does not have a dispatch
center that responds
to all radio calls.
a. 8/1/00 SE. 98th and Division.
b. 8/1/00 SW 15th and Yamhill.
c. 8/1/00 SW 2nd and Oak.
(1) The prior month the security agent had to request an officer worker to
contact the
dispatch center by phone because he was unable to obtain assistance
because his radio was
not being received by the dispatch center, when confronting a subject.
d. 8/1/00 11950 SW 2nd Beaverton.
e. A list of acknowledged radio communication problems areas.
2. Not issuing protective vests to employees that are exposed to possible
gunshots.

3. Using unsafe holsters for issued S&W Sigma 40mm handguns.
a. Using holsters designed for Beretta 92F to retain a S.W. Sigma.
(1) Beretta is a Mid frame Semiautomatic and a S&W Sigma is a Large frame
Semiautomatic.
b. Using generic holsters instead of holsters specifically designed for
the weapon.
c. Using holsters that cause the slide to be displaced when in the holster
with the snap
closed across the top (rendering the weapon inoperable).
d. Using holster that are so incorrect for the weapon that a holster is
torn when trying
to draw the weapon from the holster.
4. Not issuing proper equipment to employees to comply with State mandated
levels of
response to threats.
5. Not having on going training of employees to defend themselves, and
when engaging in
the State mandated levels of response to threats.
6. For requiring that employees assist the Fire Department without any
training in
Firefighting or Traffic Control.
