Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall hazards at an open pit at the skip hoist in the block plant: a) At McKinney Concrete, employees were exposed to fall hazards from a 6'11" deep pit where the skip hoist bucket is lowered under the mixing machine. Among other methods, one feasible and acceptable method to correct this hazard is to place a standard guardrail on the north and south sides of the pit, per industry recognized standards, as referenced by the National Concrete Masonry Association safety manual. Abatement Note: Abatement certification is not required for this item.
