Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the recognized hazard of being tossed from the ladder upon which they were working and be crushed by moving soil as they worked between the soil bank and the concrete panels. One feasible and acceptable method to correct this hazard would be to cut back the soil that was subject to move which was projecting out from under the concrete slab. ***Certification and Documentation of Abatement Required***on
