Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At the establishment, grain mill owned and operated by Stillwater Milling Company, an employee of Power Mill Contracting, Inc., was fatally injured on February 21, 2001, after he was struck and run over by a tractor trailer being backed up from a loading area. Employees were exposed to the hazard of being struck and run over by tractor trailers because the employer failed to provide audible backup alarms or other equivalent means of protection. Among other methods, two feasible and acceptable methods to correct this hazard is to ensure all company tractor trailers used in the yard are equipped with backup alarms or ensure all tractor trailers being backed up in the yard are provided with an observer at all times. ***Certification and Documentation of Abatement Required***on
