Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to a fall hazard when a Komatsu forklift was used to raise them above floor grade for access to upper tiers of storage racks. Among other methods, some feasible and acceptable methods to abate this hazard are: (1), follow the manufacturer's, Komatsu Forklift of Atlanta, Georgia, instructions prohibiting this practice; (2), substitute the fork lift for a ladder, scaffold, or other suitable equipment for this particular task. (3), utilize a safety platform with the fork lift which meets the specifications listed in ANSI B56.1-1993 or later revision. Abatement certification only is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
