North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite, Harris Teeter 5810 Prosperity Church Road -- employees working on an elevated work pallet/platform supported by a motorized rough terrain forklift without the platform being secured to lift forks and without guardrails and midrails on all open sides. NOTE: An acceptable means of abatement would be to secure the platform and to provide guardrails and midrails.s
