Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to:
(a) Residential construction site at 2003 Shoreline Drive, Windsor, CO: On
August 3,
2001,  P.W. Smith Construction Company, as the "creating" employer
(subcontractor
who built the wall that fell) and as an "exposing" employer for this
construction
project did not follow safe wall erection practices and procedures when
their
employees attempted to lift an approximately 16 foot by 19 foot
wood-framed wall
instead of using acceptable mechanical assistance.  Among other methods,
one
feasible and acceptable abatement method to correct this hazard is to use
a
crane to
lift and place this type of wood-framed wall, instead of manual lifting.

for this item (See
enclosed "Sample Abatement-Certification Letter").
