Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish a place of employment which was free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed
to fall hazards, crushing hazards, and struck by hazards:
(a)Western Summit Constructors, Inc., at 4340 Swann Mountain Road,
Dillon, CO 80435: On or before 10/5/01, the employer directed an employee
to use a scissorlift which could not withstand the horizontal forces
imposed on
it while the employee was stripping cement forms.  As a result, the
scissorlift
tipped over, causing the employee to break his shoulder.
ANSI Standard 92.6 - 1990 section 7.11.6 provides that rated capacities
shall
not be exceeded when loads are transferred to the platform at any height.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to asphyxiation:
(a)Western Summit Constructors, Inc., at 4340 Swann Mountain Road,
Dillon, CO 80435: On or before 10/5/01, the employer directed an employee
to enter into a solid waste digester, which was a confined space cement
vault,
without retesting for hazardous atmospheres.  Water could enter into the
vault
through the hole in the roof, and absorb oxygen.  Therefore the atmosphere
could have changed from the time it was tested, about one month earlier, to
the time the employee entered the vault, presenting an oxygen deficiency
hazard.
ANSI standard Z117.1 Section 6.1 provides that before entry into a confined
space, testing shall be conducted for hazardous atmospheres by a qualified
person.  In addition, Section 6.1.3 provides that if the confined space is
vacant
for any significant period of time, the atmosphere of the confined  space
shall
be retested before re-entry is permitted.
