Section 5(a)(1) of the Occupational Safety and Health Act of l970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that an employee was
exposed to the hazard of falling when getting on and off a ladder at upper
access level:
(a)American Mechanical Services, Inc., at 6445 East Ohio Ave., Denver, CO:
On October 16, 2001, the employer did not provide an appropriate portable
extension ladder that would extend at least three feet above the roof
line, to
enable safe access, for the HVAC apprentice performing heater maintenance
on
the roof of a single-story office building.  The condition exposed the
employee
to the hazard of falling when getting on and off ladder at upper access
level and
resulted in a death.
Among others, one feasible and acceptable abatement method to correct this
hazard is to ensure that when a portable extension ladder is used to gain
access to the roof, it should be extended at least three feet above the
roof line
to enable safe access and it must be tied down to prevent slipping.
