Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
At this commercial building construction site, employees were exposed to
fall
hazards and other injuries, in that scissor lift vehicles were not
inspected prior to
the start of each work day.  The employer operated both its own and rented
lift
vehicles at this site.  This safety inspection was recommended as part of a
maintenance program outlined in ANSI/SIA A92.6 (1990), "Self-Propelled
Elevating Work Platforms", Section 7.3.3 - "Pre-Start Inspection":
"Before use each day or at the beginning of each shift, the aerial
platform shall
be given a visual inspection and functional test including but not limited
to the
following: (2) Safety Devices...(10) Guardrail System."
A review of all lift vehicles on site uncovered non-functional motion
alarms (with
no alternate warning device) and poorly maintained platform guardrail
system
(corroded, replaced with electrical wire, etc.).
