Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a fall hazard:
The employer did not maintain the JLG hydraulic boom truck crane according
to the written Service and Specifications Manual dated October 15,
1986/revised June 1, 1989 and the written Operating Manual dated 15 July
1986.  On or about January 12, 2001, the lack of maintenance on leaking
hydraulic fluid lines/hoses, which operated the JLG hydraulic boom truck
crane, exposed employees to hazards associated failure of critical
components
that would  result in a free fall or free rotation of the boom.
Among other methods, one (1) feasible and acceptable abatement method to
correct the hazard is to maintain the JLG hydraulic boom truck crane
according to the manufacturer's recommendations.

were exposed to a fall hazard:
Employee working from a personnel basket at the end of the JLG hydraulic
boom
truck crane was exposed to a fall hazard of approximately twenty (20) feet
to
ground level.  On or about January 12, 2001, the front of the Ford L8000
flat
bed truck on which the crane was mounted extended four (4) feet into the
traffic
lane and traffic warning devices (cones) had not been placed in the North
bound
traffic lane of Lower Broadway Street on the South side of the vehicle.
Among other methods, one (1) feasible and acceptable abatement method to
correct the hazard is to properly and adequately instruct employees about
the
correct placement of traffic warning devices (cones) as described in
American
Standard Institute (ANSI) D6.1 1978 and J. J. Keller & Associates, Inc.
Federal
Motor Carrier SAFETY REGULATIONS Handbook dated February 1999 when
vehicles extend into the traffic lane.
