Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of falling from a height of twenty six feet to the ground. a) Durban & Shawnee construction site: A worker was raised on a broken pallet on the forks of a Lull rough terrain fork lift truck to a height of twenty six feet to perform work on the steel beams of the building under construction. No fall protection was provided to the employee. Violation observed on or about 07/24/00. ABATEMENT NOTES :Feasible & acceptable abatement methods to abate this hazard include but are not limited to: 1) Use a safety platform with guard rails secured to the lifting carriage or forks 2) Follow the requirements of American National Standards B56.6-1992, Safety Standard for Rough terrain Forklift Trucks, Section 5.15, Elevating personnel.
