Section 5(a)(1) of the Occupational Safety & Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of being infected
with Mycobacterium
tuberculosis through contact with patients who may be infectious with
tuberculosis:
a) Facility:
Healthcare worker(s) did not receive the annual PPD two-step test.
Violation occurred on or abut 06/26/00.
Feasible and useful abatement methods for reducing this hazard, as
recommended by the
Center for Disease Control, among others are:
1) Screening prospective and current residents for tuberculosis with a
rapid diagnosis service
and/or a protocol for transferring residents with suspected or confirmed
TB
to a facility equipped
with AFB (Acid Fast Bacilli) isolation.
2) Provide training to all health care workers on the hazards and controls
of tuberculosis.  The
training must include epidemiology, transmission, treatment and
pathogenesis of tuberculosis.
3) Provide health care workers with their annual PPD two step skin test
for evaluating any
conversions or clusters.  As well as providing health care workers with
information on the
purpose of the PPD skin test, the significance of a positive PPD test
result and the importance
of participating in the skin test program.ating
