Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush injuries associated with caught-in-between and struck-by hazards from construction machinery that was not equipped with seat-belts: a.) Rotunda, Inc. Construction Site/Erie, PA - Ingersoll-Rand DD-24 double vibratory roller was equipped with a rollover protective structure (ROPS) but was not equipped with a seat-belt. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to equip the Ingersoll-Rand DD-24 Double Vibratory Roller with a seat-belt and require operators to use the seat belt.
