and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:

guarded.
REFERENCE: ANSI B11.3-1982; 4.2.4.2.4 Foot-control Actuation
prevention - The foot control shall be protected so as to
inhibit accidental actuation by falling or moving objects, or
by someone stepping on it.
NOTE:  One acceptable and feasible means of abatement is to
put a cover or guard over the foot pedal.
