Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which was free from recognized hazards that were
causing or likely to cause death
or serious physical harm to employees in that employees were exposed to an
oxygen deficient atmosphere
created by the displacement of oxygen by nitrogen gas.
a) Formax Line 19 - Liquid nitrogen is used to flash freeze meat products
as they run through the
tunnel. Readings taken within an employee's breathing zone on April 17,
2002 using a MSA
Microgard gas meter, Serial Number 704, indicated levels below 19.5
oxygen. Ref. Compressed
Gas Association (CGA) P-14-1992 & CGA SB-2-1992.
Among other methods, feasible and acceptable abatement methods include the
following:
1) The installation of a scavenger ventilation system at the floor level
to capture fugitive nitrogen gas
emissions from the nitrogen tunnel.
2) Installation of an oxygen monitoring and audible alarm system.
3) Interlocking the system such that a failure of the ventilation system
would cause either the nitrogen
gas injection system to completely shut down or the conveyor system to
shut down resulting in
reducing the amount of nitrogen gas being injected.
Abatement certification required within 10 days after abatement date.  The
certification shall include a
statement that abatement is complete, date and method of abatement, and
states employees and their
representatives were informed of this abatement.tives
