Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a serious fall hazard: a) Sufficiently strong to support any load(s) which may be imposed on it, Securely attached to the lifting carriage or forks, which shall be secured so they do not pivot upward, Designed so that employees will not be exposed to an ingoing nip point, which can be created between the rear of the platform and the structure of the powered industrial truck, as a platform is raised and lowered, Designed so that personnel on the platform are protected from moving parts of the truck, Horizontal and centered and not tilted forward or reward when elevated, Provided with a fall protection system if it is elevated more than four feet above the walking/working surface or is above or adjacent to dangerous equipment. If a guardrail system is used it shall: a. consist of a toprail, approximately 42 inches in height, a midrail approximately 21 inches in height, and a toeboard if operating conditions necessitate, b. Be provided with a toprail, which will not deflect to less than 39 inches, when a 200 pound force is imposed on it, c. Be provided with a toprail that will not fail when a 200 pound force is imposed on it. Provided with fall protection, at the opening used for access and egress from it, which provides protection equivalent to that of a standard guardrail system, and Have a slip resistant surface. a) 633 Dunksferry Rd., Bensalem, Pa.,: On or about 12/11/01, the design of and calculations for the permanent support system did not address all imposed loads by the system, and the design of the hangers of the duct system were not submitted with design calculations addressing the operating parameters of the duct system including all assumed dead and live loads and including potential build up of debris in the duct system. Among other methods, one feasible and acceptable abatement method to correct this hazard includes: 1) Have a Certified Professional Engineer certify the design calculations for the permanent system addressing the operating parameters of the duct, including all assumed dead and live loads, and potential build-up of debris in the duct system, in compliance with applicable Sheet Metal and Air Conditioning Contractors National Association. 2) Address all imposed loads by the system, the use of structural support members from the existing building and assure compliance to applicable American Institute of Steel Construction, standards and building codes. 3) Have a Certified Professional Engineer certify both the permanent support system design and the design for the hangers of the duct system. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
