Section 5(a)(1) of the Occupational Safety and Health Act of 1970: King of the Road, Highway 34, York, NE- The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees exposed to forklift-related injuries due to lack of seat belt usage. Among other methods, one feasible and acceptable method to control the hazard is to develop and implement written procedures requiring operators of powered industrial trucks to wear the seat belts provided when operating trucks. Retrofitting, necessary to install seat belts on powered industrial trucks without them, will be accomplished in accordance with safe design. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
