Section 5(a)(1) of the Occupational Safety and Health Act of 1970: OPPD North Omaha Facility-The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazards of asphyxiation, chemical exposure, and physical injury associated with inadequate confined spaced entry, rescue systems, and procedures. Employee operating a standard shop vacuum was badly burned while working in the confined space of a tank. The atmosphere of the confined space had not been tested for the presence of explosive or toxic vapors. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not limited to the following: i) The Employer shall identify and evaluate the establishment for hazard identification as outlined in Section 3 of American National Standards Institute (ANSI) Z117.1-1995. ii) The employer shall conduct atmospheric testing as outline in Section 6 of ANSI Z117.1- 1995. iii) The employer shall perform isolation and lockout/tagout as oulined in Section 8 of ANSI Z117.1-1995. iv) The employer shall implement an emergency response plan as outlined in Section 14 of ANSI Z117.1-1995. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
