Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Cameron Ashley, Inc., 9737 I St., Omaha, NE: The employer did not furnish employment and a place of employment that was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Employees were exposed to serious injury in that they were: 1. Not wearing seatbelts with which the forklifts had been equipped. 2. Riding in conveyor trucks with more people than there were seats or seatbelts. Among other methods, one feasible and acceptable method to control the hazards is to: 1. Develop and enforce written procedures requiring operators of forklifts to wear seatbelts that are provided. 2. Unless the conveyor trucks can be legally and safely modified to allow two passengers, a policy should be enforced that prohibits more than two people in the vehicle. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
