Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling over 6 feet or more from a job made personnel platform and being struck by moving parts of the mast of the forklift while being elevated to perform work. Warehouse and production areas: Employees changing light bulbs while elevated on a personnel platform were not protected from falling by standard guardrails or the platform securely attached to the powered industrial truck. Employees while being elevated to change lightbulbs were not protected from the moving parts of the mast of the forklift. The job made personnel lift was secured to the forks of the powered industrial truck using a chain; however, the chain was not securely attached to the lift to prevent movement of the platform. The guardrails on the personnel lift do not meet the requirements for a standard railing, due to the lack of a midrail. The personnel inside the lift were not protected from falling by the use of a proper guardrail system or personal fall arrest system. Fork Lift M# CMP15L, S# CMP158L14066851KF. Among other methods, one feasible and acceptable method of abatement is: 1. Follow the safety procedures in ANSI B56.1-1993. 2. Provide a standard personnel lift equipped with the required safety features. 3. Verify the load capacity and suitability with the forklift used. 4. Install standard railings in accordance with 29 CFR 1910.23. 5. Require employees to wear safety harnesses and lanyards while working from the elevated platform. 6. Modify the personnel platform to ensure employees are protected from the moving parts of the mast of the forklift. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
