North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)West Third Street, Charlotte, North Carolina; employees were observed performing survey duties in the roadway and were not protected from on-coming traffic. The employees were exposed to being struck-by vehicles and the employer did not post advance warning signs, barricades, or flagmen to warn motorists of work area. NOTE: Among other methods, one feasible and acceptable method to abate this hazard is to position appropriate advance warning signs as referenced in ANSI D6.1 Manual on Uniform Traffic Control Devices For Streets and Highways.
